1. Acceptance of Terms

By downloading, installing, or using the Hablemos application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We may update these Terms from time to time. Your continued use of the App after any changes indicates your acceptance of the new Terms.

2. Description of Service

Hablemos is a Spanish language learning application that provides:

  • AI-powered conversation practice
  • Listening comprehension exercises
  • Grammar lessons and explanations
  • Vocabulary games and challenges
  • Progress tracking and achievements

The App is designed for educational purposes and is not intended to replace formal language instruction or professional translation services.

3. User Accounts

You do not need to create an account to use the basic features of Hablemos. Your progress and preferences are stored locally on your device.

If you choose to subscribe to Premium features, your subscription is managed through your Apple ID account and is subject to Apple's terms and conditions.

4. Subscriptions and Payments

Hablemos offers both free and premium subscription options:

  • Free tier: Limited daily access to conversations, listening clips, grammar lessons, and games
  • Premium tier: Unlimited access to all features

Subscription Terms:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions in your App Store account settings
  • No refunds will be provided for any unused portion of a subscription period

Free Trial: If offered, the free trial period allows you to experience Premium features before being charged. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged.

5. Acceptable Use

You agree to use Hablemos only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates any applicable law or regulation
  • Attempt to interfere with or disrupt the App's services or servers
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App to transmit harmful, offensive, or inappropriate content
  • Share your subscription access with others

6. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, audio clips, lessons, and software, is the property of Hablemos or its content suppliers and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial educational purposes.

7. Voice and Audio Data

When you use voice features in Hablemos:

  • Your voice recordings are sent to our servers for speech-to-text processing
  • Audio data is processed in real-time and is not permanently stored
  • We use third-party services (Google Cloud) to process speech recognition
  • You can use the App without the microphone by typing instead

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • The results from using the App will be accurate or reliable
  • The App will meet your specific learning requirements
  • Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABLEMOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

10. Changes to the Service

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hablemos operates, without regard to its conflict of law provisions.
